The Delaware Business Trust Act governs the Delaware Statutory Trust, a separate legal entity created under the laws of Delaware to hold title to one or more income producing commercial properties. It is considered a separate entity which, in many ways, can behave like a corporate entity, with a body of trustees, a group of beneficial owners, and can operate into perpetuity.
We support clients in forming and maintaining Delaware Statutory Trusts, filing certificates of trust with the Delaware Secretary of State, along with Trust Agreements. But perhaps most importantly, we can satisfy the Delaware Statutory Trust requirement that a Delaware resident be named as a trustee.
