Incorporating Services, Ltd. (“Incserv,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and retain personal information through incserv.com (the “Site”), the Incserv Snapshot client portal (“Snapshot”), and communications or transactions initiated through them (collectively, the “Digital Services”).
This Privacy Policy does not apply to employee or applicant information or to third-party websites and services that have their own privacy notices. It also does not govern information collected solely through offline interactions unless that information relates to an inquiry, customer relationship, or transaction involving the Digital Services.
Information you provide
Depending on how you use the Site, you may provide:
Contact information, such as your first and last name, email address, and, if requested or provided, business telephone number.
Inquiry information, including your company, country, the contents of the Site’s open-text inquiry field, and related communications.
Business and entity information needed to respond to an inquiry or provide requested services.
Transaction information, such as the service purchased, amount, date, payment status, and related billing details.
Marketing preferences, including an email address submitted to receive Incserv alerts or other communications.
Other information you choose to include in a free-text field, email, attachment, Snapshot upload, or subsequent communication.
Please do not submit Social Security numbers, full payment-card numbers, passwords, health information, or other sensitive personal information through the Site’s general inquiry form.
Payment information
Online credit-card and ACH payments are processed by Authorize.Net. Authorize.Net exclusively receives and handles full ACH account credentials. Incserv does not receive or store full payment-card numbers or complete online-banking credentials through the Digital Services. We may receive transaction details, such as your name, billing information, payment amount, payment status, and a limited card or bank-account identifier. Authorize.Net’s handling of your information is also subject to its privacy notice and terms.
Information collected automatically
When you use the Digital Services, we and our service providers may automatically collect information such as your Internet Protocol address, browser and device type, operating system, referring and exit pages, pages or portal features viewed, approximate location derived from your IP address, dates and times of access, login and session information, and interactions with the Digital Services. We may collect this information through cookies, pixels, tags, server logs, audit records, and similar technologies.
Information from other sources
We may receive personal information from service providers, payment processors, government records and agencies, referral sources, professional advisers, and customers or other persons who ask us to perform services involving you or an entity with which you are associated.
Snapshot information
When Incserv creates or administers a Snapshot account, we may collect and maintain account and profile information, login credentials, account status, customer and personal contact information, and records of account access or activity.
Snapshot may contain information about customers and entities, including entity names and identifiers, jurisdictions, status and filing history, registered-agent and compliance information, officers, directors, owners and other contacts, corporate stock and share information, invoices, transaction history, and documents or other materials uploaded to or downloaded from Snapshot.
Snapshot may also generate operational, security, and audit information, including login dates, account changes, downloads, payment activity, error records, and communications with support. The completeness and retention of these records may vary by feature and system configuration.
We may use personal information to:
Respond to inquiries, communicate with you, provide requested services, and administer our relationship with you.
Process and document payments, invoices, refunds, and other transactions.
Create and administer Snapshot accounts; provide access to entity, document, invoice, compliance, and payment information; process uploads and downloads; maintain account and entity histories; and communicate about portal activity.
Submit filings, requests, payments, or information to government agencies and other recipients as directed or required to perform services.
Operate, maintain, authenticate, secure, troubleshoot, and improve the Site, Snapshot, and our services.
Analyze Site traffic and usage, including through Google Analytics.
Send service communications and, where permitted, marketing emails or alerts. You may unsubscribe from marketing emails using the link in the message.
Detect, investigate, and prevent fraud, misuse, security incidents, and other harmful or unlawful activity.
Comply with law, court orders, regulatory requirements, and our contractual obligations; establish or defend legal claims; and enforce our terms and policies.
Carry out a merger, financing, acquisition, reorganization, sale of assets, or similar business transaction.
Use information for another purpose disclosed to you or with your consent.
The Site uses cookies and similar technologies that are necessary for operation and security and may use analytics technologies to understand how visitors use the Site. We use Google Analytics for audience measurement and Site improvement. Snapshot may use cookies and similar technologies for authentication, security, session management, preferences, and operational performance. Google may collect information about your use of the Site and process it according to Google’s policies.
You can control cookies through your browser settings. Blocking cookies may affect Site functionality. Google also offers a Google Analytics opt-out browser add-on. Incserv does not use personal information collected through the Site for cross-context behavioral advertising and does not sell personal information for monetary consideration.
Some browsers offer “Do Not Track” settings. Because there is not a single, universally accepted standard for these signals, the Site may not respond to them. Where applicable law requires recognition of an opt-out preference signal, we will process a recognized signal as required by that law.
We may disclose personal information to:
Service providers that support website and Snapshot hosting, software development and maintenance, security, authentication, analytics, communications, marketing, payment processing, document management, and other business operations.
Government agencies, courts, filing offices, registered agents, couriers, vendors, and other recipients when requested or reasonably necessary to provide services.
Professional advisers, such as attorneys, accountants, auditors, insurers, and consultants.
Law-enforcement, regulators, courts, and other parties when we believe disclosure is required or appropriate to comply with law, protect rights or safety, investigate wrongdoing, or enforce agreements.
Parties to an actual or proposed corporate transaction, such as a merger, financing, acquisition, reorganization, bankruptcy, or sale of assets.
Other persons at your direction, with your consent, or as otherwise disclosed when the information is collected.
We do not sell personal information for monetary consideration. We also do not share personal information for cross-context behavioral advertising as those terms are defined under California law.
Information submitted by customers about other people
Snapshot and Incserv’s services may contain personal information about officers, directors, owners, employees, entity contacts, clients, or other people that a customer or authorized user submits or controls. For that information, Incserv may process personal information on the customer’s instructions. If you submit a privacy request concerning customer-controlled information, we may refer the request to the relevant customer or ask you to contact that customer directly.
We retain personal information for the periods reasonably necessary for the purposes described in this Privacy Policy, including to provide services, maintain business and transaction records, comply with legal obligations, resolve disputes, and protect our rights.
General Site inquiries and related materials are generally retained for up to six months after resolution unless they become part of a customer or service record or a longer period is needed for legal, security, or dispute-resolution purposes.
Customer, entity, Snapshot, document, service, and transaction records are retained indefinitely as historical business records, including records associated with inactive entities or former customers, except where deletion is required by applicable law.
Payment-card information is retained by the payment processor according to its own policies; Incserv retains the related transaction and accounting records it receives as needed for business and legal purposes.
Analytics information is retained according to our configured settings and the policies of the analytics provider.
Snapshot access, security, and audit records are retained indefinitely for account administration, security, troubleshooting, legal compliance, dispute resolution, and historical business-record purposes. The completeness of those records may vary by feature and system configuration.
For records not assigned a specific period above, retention periods may vary based on the nature and sensitivity of the information, the purposes for which it is processed, legal or contractual requirements, and the risk of harm from unauthorized use or disclosure.
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. Snapshot is hosted and maintained with the assistance of a third-party technology provider. No method of transmission, authentication, or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for protecting your credentials, using appropriate care when sending sensitive information electronically, and promptly notifying Incserv of suspected unauthorized access.
Marketing emails: Use the unsubscribe link in a marketing email. We may continue to send non-marketing messages relating to an inquiry, transaction, or service.
Cookies: Adjust your browser settings or use available provider opt-out tools.
Updating information and access: Contact us at info@incserv.com to request an update to information you provided through the Digital Services or to request a change to Snapshot access.
Depending on where you reside and whether the applicable law covers Incserv or the particular information, you may have rights to request access to or a copy of personal information, correction, deletion, data portability, or information about our collection and disclosure practices. You may also have rights to opt out of certain sales, targeted advertising, or profiling and to limit certain uses of sensitive personal information.
Incserv does not sell personal information or use it for cross-context behavioral or targeted advertising. Please describe the right you wish to exercise and provide enough information for us to locate the relevant records. We may need to verify your identity and authority before acting. We will not discriminate against you for exercising an applicable privacy right. Where provided by law, you may appeal a decision by replying to our response.
This section supplements the rest of this Privacy Policy for California residents. It applies only to the extent the California Consumer Privacy Act, as amended (“CCPA”), applies to Incserv and the relevant personal information.
Categories collected
During the preceding 12 months, we may have collected the following CCPA categories: identifiers; customer-record information; commercial and transaction information; Internet or other electronic network activity; approximate geolocation; professional or employment-related information; and inferences drawn from Site or Snapshot activity or communications. If voluntarily provided or needed for a requested service, we may also collect information treated as sensitive personal information, such as government identifiers, account credentials, or financial information. We use sensitive personal information only for permitted business purposes and do not use or disclose it to infer characteristics about a person.
Sources, purposes, and recipients
We collect these categories directly from you, automatically from your device, from customers or others who request services involving you, from service providers and payment processors, and from public or governmental sources. We use them for the purposes described in Section 3 and may disclose them for business purposes to the recipients described in Section 5.
Sale and sharing
During the preceding 12 months, Incserv has not sold personal information for monetary or other valuable consideration and has not shared personal information for cross-context behavioral advertising. We do not knowingly sell or share the personal information of consumers under 16 years of age.
California requests
Subject to legal limitations, California residents may request to know, access, correct, or delete personal information and may obtain information about categories, sources, purposes, and disclosures. An authorized agent may submit a request on your behalf, but we may require proof of authorization and verification of your identity. Submit requests using the methods listed in Section 9.
California’s “Shine the Light” law permits certain requests regarding disclosure of personal information to third parties for their own direct-marketing purposes. Incserv does not disclose personal information to third parties for their own direct-marketing purposes.
The Digital Services are operated from the United States. If you access them from another country, your personal information may be transferred to and processed in the United States and other countries whose laws may not provide the same level of protection as the laws where you live.
Where European Economic Area, United Kingdom, or similar data-protection law applies, our legal bases for processing may include taking steps at your request before entering into a contract or performing a contract; our legitimate interests in operating, securing, improving, and promoting our business; compliance with legal obligations; and consent where required. You may have rights to access, correct, erase, restrict, or object to processing; receive portable data; withdraw consent; and complain to your local supervisory authority. These rights are subject to applicable exceptions. Where required, we use appropriate safeguards for international transfers or rely on a lawful exception. Contact us to exercise an applicable right.
The Digital Services are intended for business and professional users and are not directed to children under 16. We do not knowingly collect personal information through the Digital Services from children under 16. If you believe a child has provided personal information to us, please contact us.
The Site may link to or use third-party websites and services. Incserv is not responsible for the privacy, security, or content practices of those third parties. Review their notices before providing personal information.
We may update this Privacy Policy from time to time. We will post the revised version on the Site and update the “Last Updated” date. If required by law, we will provide additional notice or obtain consent for material changes.
