New Florida Law Affects Service of Process

Incorporating Services, Ltd. (Incserv) is an active member of the National Public Records Research Association (NPRRA). One of the many benefits of this membership is the continuous flow of information from its members regarding changes in policy, law and processing of public records searching and filing across the US. We received the below information from the NPRRA on Tuesday, September 27, 2016.

Florida Senate Bill 1104 was signed into law by Florida Governor Rick Scott on April 1, 2016. The bill allows a financial institution authorized by state or federal law to designate with the Department of State a place or registered agent as the sole location to receive service of process. Service of Process may be made on any officer, director or business agent of the financial institution at its principal place of business, or at any other branch, office or place of business in the state, if a financial institution has no registered agent. The bill becomes effective January 1, 2017.

Florida Has Declared A State Of Emergency!

The Governor of Florida has declared a State of Emergency as they brace themselves for Tropical Storm Hermine. Governor Scott announced, “Today, in preparation for Tropical Storm Hermine, I have ordered the closure of state offices and buildings in 51 counties at noon. Our employees work very hard and their safety is of the upmost importance.”

As of now, state offices will be closed in the following counties:
ALACHUA, BAKER, BAY, BRADFORD, BREVARD, CALHOUN, CITRUS, CLAY, COLUMBIA, DIXIE, DUVAL, ESCAMBIA, FLAGLER, FRANKLIN, GADSDEN, GILCHRIST, GULF, HAMILTON, HERNANDO, HILLSBOROUGH, HOLMES, JACKSON, JEFFERSON, LAFAYETTE, LAKE, LEON, LEVY, LIBERTY, MADISON, MANATEE, MARION, NASSAU, OKALOOSA, ORANGE, OSCEOLA, PASCO, PINELLAS, POLK, PUTNAM, SANTA ROSA, SARASOTA, SEMINOLE, ST. Important Change in Processing Times in Florida

Effective immediately, Florida Secretary of State processing times have changed. All corporate filing submissions that normally have a 24-48 hour processing turnaround time will now have an approximate turnaround time of 1-3 business days. Please keep in mind the Florida Secretary of State does not guarantee this time frame.

UCC work is processed with the Secured Transaction Registry and is remaining unchanged at a turnaround time of 3-5 business days.
